Estate planning is the process by which a client and attorney mutually plan for the accumulation and disposition of the client's assets in a manner that effectuates the client's goals. A successful estate plan ensures that the client's ultimate desires will be carried out after death. To prepare an effective estate plan, the estate planner needs a broad base of knowledge. A planner must understand the client's current and projected financial status; be aware of the client's fears and desires about the disposition of the estate (i.e., who will take what, when, and under which conditions); and know enough about estate, gift, and income taxation to provide the client with the most tax efficient vehicles for transferring his or her assets at death.
